Welcome to Hajde. These Terms of Service ("Terms") govern your access to and use of the Hajde mobile application and website (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Hajde, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our Services.

2. Eligibility

You must be at least 13 years old to use Hajde. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. User Accounts

• Submit spam, advertisements, or promotional content
• Violate any laws or regulations
• Infringe on intellectual property rights
• Post offensive, hateful, or discriminatory content
• Harass, threaten, or harm other users
• Attempt to hack, disrupt, or compromise our Services
• Use automated systems to access our Services
• Impersonate others or misrepresent your affiliation

5. Venue Information and Reviews

Hajde provides information about restaurants, cafes, and venues. While we strive for accuracy, we cannot guarantee that all information is current or complete. Venue information, hours, menus, and other details may change without notice.

Reviews and ratings reflect the opinions of individual users and do not represent the views of Hajde. We are not responsible for the accuracy of user-submitted reviews.

6. Intellectual Property Rights

6.1 Our Rights

The Services, including all content, features, and functionality, are owned by Hajde and protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written permission.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes, subject to these Terms.

• Uninterrupted or error-free operation
• Freedom from viruses or harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAJDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, OR €100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless Hajde and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

Your use of our Services is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Modifications to Services and Terms

We reserve the right to modify, suspend, or discontinue any part of our Services at any time. We may also update these Terms from time to time. Continued use of our Services after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by the laws of Kosovo, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through good-faith negotiations. If negotiations fail, disputes shall be submitted to the competent courts of Prishtina, Kosovo.

14. General Provisions

14.1 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14.2 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

14.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hajde regarding the Services.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
